Selling & Leasing Policies and Procedures
Any request for a Waiver of Right of First Refusal for either a sale or leasing of a unit must be submitted to the Board of Directors through their managing agent to:

Must be in writing, certified mail, return receipt requested, specifying the name and address of the intended purchaser(s) or tenant(s) and the exact terms of the proposed sale/lease. Requests must be submitted at least ten (10) days prior to the anticipated closing date or effective date of the lease.
Your cooperation in abiding with the established procedures will help expedite the processing of these requests and allow closing dates and move-in dates to be met.
IN THE CASE OF A LEASE AGREEMENT

An exact copy of the executed two (2) year Lease Agreement must be submitted to Westchester Property Management. The Lease Agreement must contain reference to the current By-laws and House rules of the Condominium and Association and tenants must acknowledge that they will comply with them.

A statement advising the Board of Directors of the exact number and names of all persons who will be occupying the unit.

At the time a request for a waiver is made, all monies due and owing the Condominium, including common charges, assessments and/or other charges outstanding against the unit must be paid in full.

Each new lease request must be accompanied by a check, payable to Hudson View Community Association in the amount of $600.00. This sum is payable by the Unit Owner and will be retained to cover the cost of processing the request.

On the renewal of a lease agreement, (same tenants in place) the request must be accompanied by a check payable to Hudson View Condominium Association in the amount of $600.00. This sum is payable by the Unit Owner and will be retained to cover the cost of processing the request.

The managing agent, Jesse Englehart of Westchester Property Management (914-686-9500) must be notified of all moving dates.
IN THE CASE OF A CONTRACT OF SALE

Exact copy of the executed Contract of Sale must be submitted to Westchester Property Management.

A statement advising the Board of Directors of the exact number and names of those persons who will be occupying the unit.

At the time a request for a Waiver is made, all monies due and owing the Condominium including Common Charges, assessments and/or other charges outstanding against the unit must be paid in full.

At the August 6, 2009 Board Meeting, the Board of Directors voted to implement a Capital Contribution for resales. Each sale request must be accompanied by a check from the buyer payable to the Hudson View Community Association. This is a non-refundable $750.00 contribution (plus an additional $250.00 for a unit with a garage) which will be deposited into the Condominium capital reserves.

Each sale request must be accompanied by a check payable to Hudson View Community Association in the amount of $200.00. This amount is due and payable by the Seller and will be retained to cover the costs of processing of the request.

The Managing Agent must be provided with the name and address of the purchaser(s) mortgage company (if any) as they wish it to appear on the Certificate of Insurance which must be requested from and issued by the insurance broker prior to closing.
The Managing Agent, Ron Joy of Westchester Property Management (914-686-9500 x127) must be notified of all moving dates.
